How Does MTPL Claims Settlement Work in 2025?

On January 1, 2025, Ukraine's new MTPL Law came into force. All MTPL policies taking effect on or after January 1, 2025, operate under the new rules.

Under the new law, starting January 1, 2025, all MTPL policies are issued with the following terms:

  • Payout limits raised to 250,000 UAH for property and 500,000 UAH for injuries to life and health
  • Zero deductible on all policies
  • Mandatory direct settlement by every insurer selling MTPL
  • No more depreciation factor applied when calculating payouts
  • Payouts can go directly to the client or to a repair shop
  • The 80,000 UAH limit on Europrotocol payouts has been removed

MTPL policies issued in 2024 remain valid through the end of 2025. These policies follow the old terms, which don't include mandatory direct settlement or the removal of the depreciation factor. So this year, Ukrainian roads will often see accidents where one driver holds a new-format policy and the other an old-format one. This can create confusion around several questions:

  • Which insurer should the injured party contact — their own, or the at-fault driver's?
  • Is depreciation applied when calculating the payout?
  • What's the insurer's liability limit?

How does settlement work in these cases? Let's break it down.

There are 4 accident scenarios:

1) Both drivers hold new-format policies (effective January 1, 2025, or later)

Settlement follows the new MTPL law in full:

  • The injured party files with their own insurer under direct settlement (provided the necessary conditions are met, covered below)
  • The payout is made without depreciation — in full
  • New limits apply: 250,000 UAH for property, 500,000 UAH for injuries

2) Both drivers hold old-format policies (effective December 31, 2024, or earlier)

There are 3 possible cases here:

  • Both drivers' insurers are part of the direct settlement agreement. The injured party files with their own insurer. The payout follows the old limits (160,000 UAH for property, 320,000 UAH for injuries), with depreciation applied.
  • Neither insurer is part of the direct settlement agreement. The injured party files with the at-fault driver's insurer. Depreciation applies, old limits apply.
  • Only one driver's insurer is part of the direct settlement agreement, while the other's is not. The injured party still files with the at-fault driver's insurer. Depreciation applies, old limits apply.

3) The injured party holds a new-format policy, the at-fault driver an old-format one

  • The injured party files with their own insurer
  • Depreciation applies
  • Old limits apply

4) The injured party holds an old-format policy, the at-fault driver a new-format one

  • The injured party files with the at-fault driver's insurer
  • Depreciation does NOT apply
  • New limits apply

It's also worth remembering that MTPL policies used to be available with a deductible. Say Driver A holds an old-format policy with a 3,200 UAH deductible. If this driver causes an accident, the injured party's compensation is reduced not just by depreciation, but by the deductible amount too. That said, the injured party has the right to claim the deductible amount back from the at-fault driver.

Direct settlement applies only when all of the following conditions are met:

  • Only 2 vehicles were involved in the accident
  • Only the vehicle was damaged (no injuries)
